Right online privacy
The right to privacy is not mentioned in the Constitution, but the Supreme Court has said that several of the amendments create this right. One of the amendments is the Fourth Amendment, which stops the police and other government agents from searching us or our property without "probable cause" to believe that we have committed a crime. Joe Turow, a professor of communication studies and online privacy at the University of Pennsylvania’s Annenberg School for Communication, says Americans felt powerless about data collected on their daily lives long before news reports exposed the scope of government surveillance. While internet privacy is widely acknowledged as the top consideration in any online interaction, as evinced by the public outcry over SOPA/CISPA, public understanding of online privacy policies is actually being negatively affected by the current trends regarding online privacy statements. Originalists often argue that there is no general right to privacy within the constitution. However, as early as 1923 the Supreme Court, recognized through decisions, that the liberty given in the 14th amendment guarantees a relatively broad right of privacy in regards to about procreation, child rearing, marriage, If you have your own internet connection and computer or other hardware, you have earned the right for privacy but if you are using someone else's connection or hardware, they should have the right to place restrictions and the ability to check and see if you have been honoring them. The right to privacy is a fundamental liberty to most Americans -- but our legal system hasn't yet caught up to the revolutionary changes in technology that have imperiled this basic right. At some point, Congress must try to create a modern privacy framework to protect individuals in what is becoming an increasingly surveillance-oriented state.
